1. Acceptance of Terms
By downloading, installing, or using the DailyAdventure mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.
These Terms constitute a binding legal agreement between you and DailyAdventure (“we,” “us,” or “our”). You can reach us at info@dailyadventureapp.com.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple- or Android-branded device that you own or control, solely for your personal, non-commercial purposes and in accordance with these Terms.
You may not: copy, modify, or distribute the App; reverse-engineer or attempt to extract the source code; sublicense or sell access to the App; use the App for any unlawful purpose.
3. Apple and Google App Store Terms
The App is distributed through the Apple App Store and Google Play Store. Your use of the App is also subject to the usage rules set forth in the applicable App Store terms of service. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
Maintenance and support of the App is our responsibility, not Apple’s or Google’s. Apple and Google have no warranty obligations with respect to the App and are not responsible for any claims relating to it, including product liability claims, consumer protection claims, and intellectual property infringement claims.
4. Subscriptions and In-App Purchases
4.1 Premium Subscription DailyAdventure offers an optional auto-renewing Premium subscription (“DailyAdventure Premium”) that unlocks additional features including all 12 months of bucket list planning, savings goal tracking, AI-powered adventure suggestions, and more.
4.2 Pricing
- Monthly Plan: $4.99 per month
- Yearly Plan: $39.99 per year ($3.33/month)
Prices are displayed in the App before purchase and may vary by region as determined by Apple or Google.
4.3 Auto-Renewal Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. You can manage and cancel your subscription at any time through your device’s App Store account settings.
4.4 Free Trial If a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.
4.5 Refunds All purchases are final and non-refundable, except as required by applicable law or as provided by Apple or Google under their standard refund policies.
4.6 Restore Purchases You can restore a previous purchase at any time using the “Restore Purchases” option in the App Settings.
5. Account and Data
5.1 Anonymous Use The App may be used without creating an account. An anonymous session is created automatically to save your data locally.
5.2 Google Sign-In (Optional) You may optionally link a Google account to back up your data to the cloud. By doing so, you authorize us to store your adventure history, bucket list, and preferences associated with your Google account.
5.3 Account Deletion You may delete your account and all associated data at any time through the Settings screen. Subscription purchases must be cancelled separately through your App Store account settings.
6. Location and Calendar Data
The App may request access to your device’s location to find nearby adventures, events, and restaurants. This data is used only to generate suggestions and is not stored on our servers.
The App may request read-only access to your calendar to suggest adventures that fit your free time. We do not write to your calendar, and calendar data is never transmitted to our servers or shared with third parties.
You may deny or revoke these permissions at any time through your device settings. The App will continue to function with reduced personalization.
7. Third-Party Services
The App integrates with the following third-party services to surface adventure suggestions. Your use of content from these services is subject to their respective terms:
- Ticketmaster — Live event data (ticketmaster.com/legal)
- Google Places — Nearby restaurants and attractions (policies.google.com/terms)
- Viator — Bookable experiences (viator.com/legal)
Clicking “Book on Viator” or event links will take you to those platforms. DailyAdventure is not responsible for third-party purchases, cancellations, or disputes.
DailyAdventure may earn affiliate commissions when you book through Viator. This does not affect the suggestions you see or any pricing you encounter.
8. User-Generated Content
You may submit custom adventure names, photos, and feedback through the App. By doing so, you grant us a non-exclusive, royalty-free license to use that content to operate and improve the App. You represent that you have the rights to share any content you submit.
We do not sell user-generated content or use it for advertising purposes.
9. Prohibited Conduct
You agree not to:
- Use the App in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to any part of the App or its backend systems
- Use automated tools to scrape, crawl, or extract data from the App
- Impersonate any person or entity
- Transmit harmful, offensive, or illegal content through any feedback or social features
10. Disclaimers
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Adventure suggestions are provided for informational and entertainment purposes. We make no guarantee that any suggested location is open, available, safe, or suitable for any particular person or group. Always exercise your own judgment and take appropriate precautions when participating in outdoor or physical activities.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DAILYADVENTURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you in full.
12. Indemnification
You agree to indemnify and hold harmless DailyAdventure and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of another party.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the “Last Updated” date and, where appropriate, through an in-app notice. Continued use of the App after changes constitutes your acceptance of the revised Terms.
14. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App at any time.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Diego County, California.
